Hans Madsen
Hans Madsen deals primarily with commercial contracts – including negotiation, drafting and interpretation.
Hans has a right of audience before the Danish High Courts and is advisor to a number of listed companies such as major Danish energy company Ørsted, leading satellite manufacturer GomSpace and leading Danish media company JP/Politikens Hus. He has a wealth of experience in complex, non-standard contracts characterised by long contract periods and by having to provide for unforeseen factors such as market developments, physical conditions and legislative action.

Experience
- Hans is advisor to major Danish energy company Ørsted on long-term gas purchase agreements. He assists in contractual negotiations on contract period, conditions of supply, price adjustment terms, force-majeure clauses, interpretation issues, renegotiation issues and termination options, etc. The agreements are comprehensive and complex and must provide for long contract periods, market developments, physical conditions and legislative action.
- Hans is advisor to GomSpace, a listed manufacturer of satellite solutions. He assists in negotiating and drafting contracts setting out the terms during both construction and operation. The contracts are particularly complex, as it is not possible to access the satellites in space and so it is difficult to identify any defect and determine liability. As a result, a catalogue is prepared detailing sanctions for non-performance, which requires a lot from the contract. Hans also advises on reporting requirements and GomSpace’s possibilities for complying with these requirements in connection with funding – particularly from pools managed by ESA.
